2019 JELD‑WEN Bring It Home Sweepstakes

OFFICIAL RULES

1. SWEEPSTAKES DESCRIPTION. The JELD-WEN Bring It Home Sweepstakes (the “Sweepstakes”) is a chance sweepstakes where a travel voucher will be awarded to one winner each quarter for four quarters, based on a random drawing from all eligible entries received during the Sweepstakes Period. The voucher will be awarded by JELD-WEN, INC., 2645 Silver Crescent Drive, Charlotte, NC 28273 (“JELD-WEN” or “Sponsor”) as a prize; this Sweepstakes will be administrated by Creative Media Development, Inc., 1631 NW Thurman Street #400, Portland, OR 97209 (“CMD” or “Administrator”), and fulfilled by Van Zile Travel, (“Travel Service”).
2. ELIGIBILITY. The Sweepstakes is only open to qualified builders (“Entrant(s)”) who: (a) are legal residents of one of the 50 United States, or the District of Columbia, and are at least 18 years of age at the start of the Sweepstakes Period; and (b) verify that she or he possesses a valid builder/contractor license that has been issued by a state, county or municipality within one of the 50 United States. Employees of dealers and other resellers of JELD-WEN products and Sponsor/Administrator and their contracted employees, and/or immediate families are ineligible to participate in the Sweepstakes. Void in Puerto Rico, the U.S. Virgin Islands, and U.S. military installations in foreign countries, all other U.S. territories and possessions, and wherever else restricted or prohibited by law.
3. SWEEPSTAKES PERIOD. The “Sweepstakes Period” begins January 10, 2019 at 8:00:01 a.m. U.S. Eastern Standard Time (“EST”) and ends December 31, 2019 at 11:59:59 p.m. EST.
4. HOW TO ENTER. There are two (2) ways to enter the Sweepstakes. (1) Qualified Entrants can sign on to bringithome.jeldwen.com and complete the entry form. (2) Qualified Entrants can register to win in person at the International Builders Show Trade Show (IBS) located in Las Vegas, NV at Booth #C5230 on February 19, 2019 starting at 9:00am EST and ending 5pm EST on February 21, 2019. You must have your IBS Trade Show badge scanned at the booth in order to be qualified. All entries must be received no later than 11:59:59 p.m. EST on December 31, 2019, according to the computer time on Sponsor’s server. The information Entrants provide will only be used for administering this Sweepstakes and for marketing purposes in accordance with Sponsor’s privacy policy, located at http://www.jeldwen.com/en-us/product-support/information/privacy-policy. There is a limit of two (2) Entries per person, per email address, for the Sweepstakes: the first MUST be through the registration form, and the second MUST be through the IBS badge scan.
5. RANDOM DRAWING. One (1) winner will be randomly selected each quarter from all eligible entries received during the Sweepstakes Period. Entries that are not selected as winners will carry over into the next month’s drawing throughout the sweepstakes period. Odds of winning depend on the number of eligible entries received.
6. PRIZE DESCRIPTION. Sponsor will award one ten-thousand-dollar ($10,000) travel voucher through Van Zile Travel Service for booking a trip of the winner’s choice, plus up to $5,000 in funds to help cover taxes, each of the four quarters of the Sweepstakes Period through Van Zile Travel Service for booking a trip of the winner’s choice. There will be a total of four (4) prizes awarded, each with an approximate retail value (ARV) of up to $15,000. Any difference between stated approximate retail value and actual value of prize will not be awarded. All prize details not specified in the Official Rules will be determined at Sponsor’s sole and absolute discretion. The difference in value will not be awarded to the winner.
   
   The voucher is valid for travel offered by Van Zile Travel Service and its preferred suppliers only. Reservations must be made within one year of awarding the voucher. Travel must be completed within one year of booking the travel, and is subject to certain blackout dates, rules and restrictions. There is no cancellation or refund policy applicable to this voucher; once redeemed it becomes null and void. This voucher is nontransferable, may not be redeemed for cash, holds no cash value and must accompany your travel request. Maximum value of each travel voucher is $10,000.00. Any additional amount is the responsibility of the travelers and must be paid directly to Van Zile Travel Service. Awarded amount must be used in its entirety upon redemption and may not be used for multiple travel dates. Please note that a processing fee may be applied. Administrator, Travel Service, and Sponsor are not responsible for any lost or stolen vouchers. Restrictions apply. This voucher must be presented to Van Zile Travel Service prior to making travel arrangements. Travel voucher must be used in conjunction with a Van Zile Travel Service booking and is not redeemable for travel booked through any agency or travel supplier other than Van Zile Travel Service.
   
   Winner is solely responsible for any and all expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to all additional ground transportation, in-room charges, additional meals and beverages, gratuities, travel upgrades, baggage fees and personal incidentals. Any and all cash expenses as part of the travel are not included as part of the voucher.
   
   The trip is subject to terms and conditions set forth in these Official Rules and other material restrictions may apply. Winner and guest(s) must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license, passport, etc.) required for travel. Winner and guest(s) must travel on same itinerary. Sponsor is not responsible for any fees or additional charges resulting from a winner’s or guest’s change to itinerary or accommodations. Administrator shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by an air carrier or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage. If the winner becomes disabled or cannot otherwise fully enjoy the prize due to illness, Sponsor shall have the option at its sole discretion of being relieved of liability for fulfillment of the prize award and no other compensation in lieu of the prize will be awarded. Additional prize award details and travel information to be provided to the winner at the time of contact with Van Zile Travel Service. Lost, stolen or damaged airline tickets, travel vouchers or certificates or show tickets will not be replaced or exchanged.
   
   Administrator, Travel Service, and Sponsor are not responsible for any delay or cancellation of prize event due to unforeseen circumstances, or those outside of Sponsor’s control. Winner and guest(s) agree to comply with all applicable venue regulations in connection with hotels. Administrator and the applicable venue representatives reserve the right to remove or to deny entry to winner and his/her guest(s) who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the hotel/casino or in any other objectionable behavior.
7. PRIZE RESTRICTIONS. Prizes will be awarded provided that eligible entries have been received to conduct the drawing. Prizes are nontransferable, and no cash equivalent or substitutions allowed except at the discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. All federal, state or other tax liabilities (including income taxes) arising from this Sweepstakes will be the sole responsibility of Selected Entrant and Selected Entrant may be issued an IRS Form 1099 for the ARV of the prize. Only one (1) prize per person. ARVs are as of date of printing of these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.
   
   Each winning Entrant will be required to sign and return an Affidavit of Eligibility/Release of Liability and (except where prohibited) a Publicity Release form, including proof of employment as a professional builder, remodeler or architect, and where lawful, a publicity consent agreement, all within three (3) days of acknowledged notification. In the absence of a signed release of liability and by taking possession of the voucher, the selected winning Entrant agrees to release, discharge and not commence any lawsuit or claim against JELD-WEN, Inc., its shareholders, directors, officers, employees and agents, based on any bodily injury, death or damage to property, arising out of the winning Entrant’s travel.
8. WINNER NOTIFICATION. Potential winners will be required to respond to the Winner Notification email or a phone call within three (3) working days. Each Sweepstakes winner will be required to execute and return a witnessed Affidavit of Eligibility/Release of Liability and (except where prohibited) a Publicity Release form. All required forms must be completed and returned within three (3) working days of receipt. Failure to return required forms in these time periods will result in such winner being disqualified and subsequent drawing held to pick an alternate. Any prize notification or prize returned to Sponsor or its fulfillment company as undeliverable for any reason will be forfeited, and Sponsor shall have the option to award the prize to an alternate. All federal, state and local taxes are sole responsibility of winners. Acceptance of a prize constitutes permission (except where prohibited) to use winner's name, likeness and statements for publicity without additional compensation or limitation.
9. DISQUALIFIED ENTRIES. Sponsor and Administrator are not responsible for late, incomplete, void, corrupted, garbled, misdirected or otherwise unintelligible Entries and for any problems, bugs or malfunctions Entrants may encounter when submitting their entries. Incomplete, garbled, corrupted or otherwise illegible entries are void and will not be accepted. Sponsor and Administrator reserve the right to disqualify false entries or entries suspected of being false and to disqualify any Entrant it finds to be tampering with the entry process or the operation of the Sweepstakes or violating these Official Rules. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.
10. RELEASE. Selected winning, or alternative winning, Entrant also agrees to release, discharge, indemnify and hold harmless Sponsor, its partners and agencies (including but not limited to JELDWEN, CMD, and Van Zile Travel), and its officers, directors, employees, representatives and agents from and against any claims, damages, disability, attorneys’ fees and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from: (i) any travel resulting from the prize, or (ii) participation in any Sweepstakes-related activity or participation in this Sweepstakes. Sponsor reserves the right to disqualify any Entrant it finds to be tampering with the entry process or the operation of the Sweepstakes or violating these Official Rules and reserves the right at its sole discretion to terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner(s) in a random drawing from among all eligible, non-suspect entries received prior to action taken. Sponsor shall not be liable for: (i) late, lost, delayed, void, corrupted, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or declarations, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical malfunctions, bugs, lost connections, disconnections, delays or transmission errors Sweepstakes Entrants may encounter when submitting their entry; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the leased Vehicle or resulting from acceptance, possession or use of the leased Vehicle, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Caution: any attempt to deliberately damage or undermine the legitimate operation of the sweepstakes may be in violation of criminal and civil laws and will result in disqualification from participation in the Sweepstakes. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.
11. DISPUTES. Disputes regarding these Official Rules and/or this Sweepstakes will be governed by the internal laws of the State of North Carolina. By entering, you consent to jurisdiction in the federal and state courts of North Carolina for the resolution of any and all disputes. Each Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of North Carolina; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event shall attorneys’ fees be awarded; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant herby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether the State of North Carolina or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of North Carolina.
12. PRIVACY. All personal information collected by Sponsor will be used for administration of the Sweepstakes, and business and marketing purposes by Sponsor and Administrator in accordance with Sponsor’s Privacy Policy noted above. In addition, Entrants may receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s privacy policy. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines and to supply information to entities that comply with CAN-SPAM guidelines, and Entrants may subsequently opt out of receiving further emails by following the opt-out instructions contained in the email. Any questions regarding privacy matters should be directed to the address set out below. Please refer to Sponsor’s privacy policy located at http://www.jeld-wen.com/en-us/product-support/information/privacy-policy for important information regarding the collection, use and disclosure of personal information by Sponsor.
13. GENERAL CONDITIONS. Sponsor’s computer is the official clock for purposes of the Sweepstakes. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond its control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of these Official Rules or in a disruptive manner. Any attempt by any person to deliberately damage Sponsor’s or any related website or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law (as well as disqualifying such individual, if appropriate). Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. These Official Rules (or any other Sweepstakes materials) may not be published elsewhere without the express written consent of Sponsor, which may be withheld for any reason.
14. WINNERS LIST. To request a copy of the winners list, send an email to contest@cmdagency.com and print JELD-WEN Bring It Home Sweepstakes in the subject line. Requests must be received by February 28, 2020.
